WHAT IS PROBATE?
Probate is a legal process that manages the distribution of a person’s assets and property after they pass away. While many individuals believe that having a will exempts them from probate, this is not always the case. Property held solely in one’s name will likely still need to go through probate court, where a judge will determine the validity of a will and ensure that assets are distributed according to state laws if there is no will present. A representative, such as an executor or administrator, will also be appointed during this process, which typically lasts for at least six months. It’s important to note that certain assets, such as joint property, IRAs, annuities, and life insurance with named beneficiaries, are not subject to probate.
